These General Terms and Conditions (GTC) apply to all usage relationships between Turmitus.Tech, c/o orientas.digital, St. Niklausstrasse 8, CH-3425 Koppigen, Switzerland (hereinafter "we", "us" or "Provider"), and the users (hereinafter "you" or "user") of the services offered via the website BackgroundTrace.com (hereinafter "Service").
By registering and using the Service, you accept these GTC in their respectively valid version.
BackgroundTrace.com is an online platform that automatically researches, collects, and summarizes publicly available information on the internet (Open Source Intelligence, OSINT) about a specific person in a structured report. The Service includes in particular:

The Service is only available to natural persons of legal age or legal entities. By registering, you commit to providing truthful information and keeping your access data confidential. You may only use the Service for legal purposes. It is prohibited to use the Service to:
A fee may apply for using the Service (single report retrieval or subscription). A contract is formed through your order and our subsequent activation of the Service. All prices are stated in Euros and are plus statutory value-added tax.
You may cancel your user account at any time. We reserve the right to block or delete your account without prior notice in case of violations of these GTC, particularly § 3.
The reports created by us, the software, and the website are protected by copyright. We grant you a simple, non-transferable license to use the generated reports for your personal, internal use. Distribution, reproduction, or commercial use of the reports beyond this purpose is not permitted without our express consent.
This section is of crucial importance and limits our liability towards you.
Use of the Service and the information obtained is at your own risk. The results are automatically generated and may be incomplete, outdated, or incorrect.
We are fully liable only for intent and gross negligence as well as in cases of injury to life, body, or health. For ordinary negligence, we are only liable in case of breach of a material contractual obligation (cardinal duty). In this case, liability is limited to the typically foreseeable damage.
Liability for indirect damages, lost profits, or data loss is excluded to the extent permitted by law. This limitation of liability does not apply in case of a guaranteed characteristic or in case of fraud.
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
The place of jurisdiction for all disputes arising from or in connection with these GTC is our place of business, provided you are a merchant, a legal entity under public law, or a public special fund. However, we are also entitled to sue you at your general place of jurisdiction.
Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a legally permissible regulation that comes closest to the economic purpose of the invalid provision.
